AN AVERTER OF EVIL?

The Union Government removed Mr. Gopal Subramanium from the list of four names recommended by the Supreme Court Collegiums for appointment as the judges of the Supreme Court of India. The media reported this on 25 June 2014.
          The government said that he was not suitable for the job. It cited the report of the Central Bureau of Investigation (CBI) and Intelligence Bureau (IB) in support of its stand.
          Mr. Subramanium said that he was let down by Mr. Narendra Modi led NDA government. He alleged that there was a carefully orchestrated drama to scuttle his elevation.
          Former Supreme Court judge V.R. Krishna Iyer, former Union Minister and advocate Shanthi Bhusan, Communist Party of India (Marxist) and the media criticized the decision.
          Mr. Gopal Subramanium had been the Solicitor General of India. He has been the counsel of the CBI for many important cases. The Supreme Court has a special affinity for him as he has been its amicus curiae in many important cases.
          If a Union Minister hands over public assets to his kith and kin, he need not receive any bribe. Therefore, the guilt is the violation of law and not the exchange of money between two third parties as in the case of former Telecom Minister Mr. A. Raja. But the system behaves like a dog that quarrels with the stone keeping the assailant in a safe place.
          As the Union Ministers must obey the laws, the present man repeatedly requested the Supreme Court to point out the law violated by Mr. A. Raja in the 2G case. Finally, the present man was constrained to say that the Union Ministers –as law makers- cannot do anything illegal.         
          In the so-called coal case, the present man said that all minerals come under a class. Then, it was pointed out that the Supreme Court exists not for narrow but for broad interpretation. After that, the present man said a special law must be enacted to treat coal alone as a special class.
          The founding fathers of the Constitution of India did not deem it necessary to remove the key to the temple vaults of Sri Padmaabha Swamy temple at Thiruvananthapuram from the Travancore royal family. They did not envisage that even the Parliament would ever deem it necessary. But the Supreme Court enacted a law that would in no way reinforce the security of the vaults.
          In the past, one day, the Supreme Court cancelled the petrol outlets granted by the MPs. On the next day, it allowed the private parties to distribute the same all over India!
          Above all, the Supreme Court refuses to do justice to the letters from the President of India. It has not given its reply even to the letter No. 239 dated 11-01-2014 forwarded to it on June 2, 2014 by the present government.
          Mr. Gopal Subramaniuam has been helping the courts to perpetrate such illegalities upon the people. He does not advise the court to give answers to the letters from the government and the President of India.
Evidently, had he been elevated, the whole nation will have fallen under the yoke of such judges.
          The IB might have felt that he let down the CBI and the nation because of his ignorance.
          The Hindu says that the real reason behind his exclusion is not known. Perhaps, the paper considers the decision as a coup against the system.
          The role played by the Union Ministers and the advisers to the prime minister in this matter is not known. Someone might have alerted him. He deserves special recognition.
          Whatever happened, Prime Minister Mr. Modi averted an evil. Future alone would tell whether he would continue to function as the averter of evil or not.
          Now, the five senior judges of the collegiums, if they are worthy of the name, must show this letter not to some part of the people but to the whole and survive.
          Mr. Subramaium would do everything at his command to give ‘Measure for Measure’ is a different matter.

Prime Minister Mr. Narendra Modi posted the following in his blog on 26 June 2014.
“A few thoughts as we complete a month in office”.
Dear Friends,
Today our Government completes a month in office. The support and affection of the people has been overwhelming and this inspires us to work even harder.
67 years of previous governments is nothing compared to 1 month, but I do want to say that in the last month, our entire team has devoted every single moment for the welfare of the people. Every decision we took has been guided solely by national interest.
When we took over a month ago, I kept thinking that I am new to this place and some people believed that I would take at least a year or even two to learn the intricacies of the working of the Central Government. Fortunately, a month later that thought does not exist any longer in my mind. My confidence and determination has increased tremendously and I credit a substantial part of this to the collective experience and wisdom of my ministerial colleagues and also to my experiences as a four time Chief Minister. The affection of the people and support from officials has also added to this confidence in large measure.
Over the past few days I have been meeting Ministers and Officials from various departments who have been making detailed presentations to me. I must share that these presentations have enabled a wonderful exchange of thoughts and ideas and we have come up with excellent roadmaps for the various ministries and departments.
CMs of several states have met me in the past month. They have extended their good wishes and talked about issues concerning their state. I look forward to working closely with them in the times to come.
I feel there are areas where surely we need to improve. A big challenge I am facing in Delhi is to convey to a select group of people about our intentions and sincerity to bring a positive change in this country. These are people who are both within and outside the government system. There have been some instances in the last month with which our Government had nothing to do yet these controversies have persisted. I don’t blame anybody but I surely feel that we need to strengthen systems whereby the right things are communicated to the right people at the right time. Hopefully things will change then.
Every new Government has something that friends in the media like to call a ‘honeymoon period.’ Previous governments had the luxury of extending this ‘honeymoon period’ up to a hundred days and even beyond. Not unexpectedly I don’t have any such luxury. Forget hundred days, the series of allegations began in less than a hundred hours. But when one is working with the sole aim of serving the nation determinately, these things do not matter. That is why I keep working and that is most satisfying.
26th of June is an important date for me. It marks the completion of one month of our journey to fulfil the aspirations of the people. This day is also another landmark day, when in 1975 I witnessed an important phase that taught me the significance of a vibrant democracy. 26th June was the day when the Emergency started, having been imposed an evening earlier. As a youngster, I have several memories of those testing times.
The Emergency surely stands out as one of the darkest periods in our history and is a grim reminder of the dangers associated with subverting freedom of speech, press, expression and silencing opposition. Our democracy will not sustain if we can’t guarantee freedom of speech and expression. Today is also a day to reaffirm our pledge to safeguard these values and at the same time create strong institutions through good governance so that that we never ever see those dark days again.
Once again I salute the people of India for their strong support and good wishes as we complete a month in office. I assure you that we are committed to taking India to greater heights in the years to come.

          Vice President Hamid Ansari and Union Minister of State for Commerce and Industry Nirmala Sitharaman paid a visit to China on 26 June 2014.
          On board the aircraft Mr. Ansari said that trade imbalance was a matter of concern and the government was seized of the matter.
 His view is consistent with the view expressed in this work.

Former Defence Minister Mr.A.K. Antony, on 26 June 2014, described 100 percent Foreign Direct Investment (FDI) in the manufacture of defence equipment as an anti-constitutional act.
Is it worse than importing them? He must enlighten the public in this matter.

A gas pipeline explosion at the Andra Pradesh State killed 15 people on 28 June 2014.
Imagine the consequences of a nuclear explosion in a power plant.

Home Minister Rajnath Singh, on 28 June 2014, said that the new government would not talk with the militant people.
The government must talk to know their views. So long as the head of the government seeks to transmit the natural assets to private men, it has no moral or constitutional right to fight with them.
Even otherwise, will any government that acts in “national interest”  ever be guilty of theft?
Prime Minister Mr. Modi must give a reply.

Prime Minister of India Mr. Narendra Modi paid a two day visit to Bhutan on 15 June 2014.
Addressing the joint session of the Bhutanese National Assembly he said that education strengthens democracy. A good neighbour, he said, is important for a country’s happiness, and in its absence a nation cannot live in peace. He added that a strong Bhutan would benefit India like a strong and prosperous India would benefit the countries of the region.
          Bhutan promised not to use its territory against India.
The two countries agreed to go hand in hand on issues relating to their national interest.

          The media, on 16 June 2014, started giving great importance to Mrs. Sonia Gandhi.
          The moment Prime Minister Mr. Narendra Modi tends to give Freedom, the manipulators will recall her. Now, it appears that they have asked her to remain in a state of readiness to receive power.

          The Governor, Reserve Bank of India (RBI), Mr. Reghuram Rajan, on 16 June 2014, claimed that the RBI had maintained a reputation for integrity. He said that excessive legal supervision on financial regulators must be avoided. He cautioned that not everything the regulator does could be proven in a court of law.
          It must be noted that he said the above immediately after a meeting with Prime Minister Mr. Modi.
          No nation would survive, if the highest regulator begins to act in very bad faith.
It must be recalled that the Bank of India (BoI) gave a loan of about Re. 850 crore to an industrialist to buy a Public Sector Undertaking (PSU) during the period of Mr. A.B. Vajpayee. This happened because his head sought to appropriate the Nation. The present man mentioned this in letter No. 8 dated 3-02-2002.
 The Central Bureau of Investigation (CBI) and the Supreme Court of India did not allow the law to take its own course because they were parties to the manipulation.
However, the then Governor of the RBI, Mr. Bimal Jalan, resigned.
          Now everyone knows that former Prime Minister Dr. Manmohan Singh handed over Re. 3 lakh crore to private parties because his head sought to appropriate the whole Nation to himself and rule India.
Yet, the present Governor should reveal the method of utilization of Re. 3 lakh crore in the Provident Fund (PF). Every Indian –even if he lives like an animal- must know this. His head should not seek to cover up this matter.

The Union Minister of state Mr. Prakash Javadekar, on 23 June 2014, said that the job of the government is not to create roadblocks but to facilitate entrepreneurship.
The minerals must be handed over to A, B and C for greater job potential and public welfare. This is one principle.
According to another principle, the minerals must be in the hand of the government to achieve the same objectives.
The government is free to choose anything.
But it shall not choose anything that demands the denial of Freedom.
If the people are given the Freedom to know this work, they would compel the government to choose the former.

          The Union Government, on 17 June 2014, appointed former Chief Justice of India R.C. Lahoti as the arbitrator in the Re. 20,000 crore Vodafone tax case.
          The President of India had referred hundreds of letters to the Supreme Court of India. As the Chief Justice of India, he had not done justice to the letters. Now the government entrusts him with public duties as a reward for his bad work.

          Finance Minister Mr. Arun Jaitely, on 18 June 2014, rescued himself from the Vodafone case. He had been a tax consultant of the Vodofone before becoming a minister.
          Many big companies had approached him. They, in turn, handed over political power to him.

          Information and Broadcasting Minister Mr. Prakash Javadekar, on 19 June 2014, said that the Government would not control the media.
          He should have asked the media to tell the reason why they conceal this work. Instead, he says that Freedom is dangerous to Indians and that they should not know this work.

          The Department of Income Tax, on 19 June 2014, sent notices to ex-Central Bureau of Investigation (CBI) chief Mr. A.P. Singh. He is now a member of the Union Public Service Commission (UPSC).
          The CBI takes away the police power of the country. It exists to protect big offenders by denying Freedom. No wonder, the competent authorities have sent a notice to him.
          If the Prime Minister is not ready to misuse his power, many officers would be charge-sheeted for concealing this work and for many other manipulations.

           Competent authorities, on 19 June 2014, raided a hotel at Chennai for tax evasion. The newspapers did not publish it on the next day. Apparently, they are behaving like thieves.
          The present writer had given a concrete suggestion to avoid such raids. Apparently, the Cabinet Secretary has not brought this to the notice of the new prime minister.

          The Union Government, on 20 June 2014, hiked the railway passenger fares by 14.2 per cent and freight fares by 6.5 per cent to fetch Re. 8000 crore per year.
          A need not subsidize B for his travel.
 But a miner alone gets more than Re.8000 crore per year. The government is not ready to touch him!

          India, on 22 June 2014, ratified IAEA Additional Protocol that provides inspection of the safeguarded nuclear facilities. It is a commendable decision.

          The Government of Switzerland, on 22 June 2014, agreed to provide a list of Indian account holders in Swiss banks. Later, it denied the report.

          Bowing to the pressure from the MPs belonging to the BJP and Shiv Sena, the government, on 24 June 2014, said that the hike in rail fare would not apply to suburban passengers.
          The BJP first wanted to hike the fares. Now they want to retract!

The Union Minister for Law and Justice, Mr. Ravi Sankar Prasad, said that the laws for single window clearance would be simplified. It was the front page headline news of The Hindu on 25 June 2014.
It must be acknowledged that the government forwarded a letter to the Supreme Court of India immediately after he assumed power. But he had not made it public. This helps cover up this work.

          Union Finance Minister Mr. Arun Jaitley said that he would restore investor confidence in the Budget to be presented on July 10, 2014. The New Indian Express published his words in bold letters on 25 June 2014.
          He is silent about the PF. He suppresses many points present in this work.
          The Budget may not contain anything substantial for public welfare or for restoring constitutionalism.
          However, the people keep their fingers crossed.

          This is letter No.262.
          Now, many Union Ministers talk but not the Prime Minister. In fact, the Prime Minister has not uttered a word to the people since June 17, 2014. It is unfortunate that a common man has to write a letter for his Freedom.
          The Prime Minister must prove that the Nation has passed into a truer form after the election.

“Good counsel is a kind of knowledge”

The media, on 30 May 2014, blacked out all activities of Prime Minister Mr. Narendra Modi. They, thus, concealed the immediate impacts of the last letter.
If the Prime Minister of India has no Freedom, he cannot give Freedom to the people.

Finance Minister Mr. Arun Jaitely cleared the sale of the residual shares of the Hidustan Zinc Limited (HZL) and the Bharath Aluminium Company (BALCO). The newspapers reported this on 29 May 2014.
          The clearance is in accordance with the taste of the manipulators. The announcement had come just a few minutes before the receipt of the letter No.260 by the President of India.
          In view of the last letter, the clearance would remain unfruitful.

          The Prime Minister of India, Mr. Narendra Modi, on 31 May 2014, abolished all the 27 Group of Ministers (GoM) and 24 Empowered Group of Ministers (EGoM).
          The above decision was taken within 36 hours of the receipt of the last letter by the President of India. The decision was, apparently, taken to put an end to the lawlessness mentioned in the last letter. This shows that Prime Minister Mr. Modi is a quick decision maker.
          In this connection, it must be stated that the GoMs and the EGoM can be parts of the Union Cabinet. But they are not a substitute for it. This is because no part can play the role of the whole. 
          Congress Party, however, described the decision as symptomatic of autocratic regime and noted that “no single person shall be repository of all wisdom”.
          What does the Congress Party mean by “single person” in a Cabinet system of government is not a clear one.

Prime Minister Mr. Modi, on 1 June 2014, justified the invitation extended to the leaders of the SAARC nations to his swearing in ceremony. He asked everyone to live up to the expectations of the people. He added that the trust of the people should not be broken.
          On the same day, he said that the democracy of the country must be strengthened so that the world would give the respect it deserves.
He talked like this presumably because of the realization that India is not a democracy.
          He must call on the Queen of England as a courtesy for the contribution she made to the Freedom of Indians. This would restore the reputation of India.

          The Governor of the Reserve Bank of India (RBI), Mr.Reghuram Rajan, called on Prime Minister Mr. Modi, at New Delhi on 1 June 2014. He might have explained the plight of the Re.3 lakh crore in the Provident Fund (PF).
           His continuance as the Governor of the RBI is an untenable one because he has not restored the public money.

          Odisha chief minister Mr. Naveen Patnaik, on 2 June 2014, called on Prime Minister Mr. Modi at New Delhi. He told him that the mining entities were getting super normal profits. He requested him to give Special Category Status to his State.
          Mr. Patnaik has officially pointed out the criminality in the exploitation of ores. It is a vindication of this work.
          However, the Government of Odisha is transmitting its natural resources to private parties in very bad faith. A State that alienates the natural resources forfeits its moral and constitutional right to approach the Union Government.
          Now the Union Government cannot but direct all States to take over their natural resources.

          Union Rural Development Minister Mr. Gopinath Munde died in a car accident at Delhi on 3 June 2014.
          The existing security system for the very important persons (VIPs) must be disbanded and handed over to a new team.
Further, the experience shows that the VIPs must avoid helicopters.

Prime Minister Mr. Modi convened a meeting of all secretaries on 4 June 2014. In all 77 bureaucrats attended the meeting. The ministers were conspicuous by their absence. It was the first time a prime minister met the secretaries without the ministers.
The Prime Minister interacted with them for three hours. Apparently, he asked them not to obey the illegal orders of anyone.
Further, he advised them to approach him with any ideas.
There is no dearth of ideas. In fact, a good counsel is a kind of knowledge. But the government is the enemy of not only ideas but also knowledge.
For instance, abolition of the policy of bulk buying would curtail the generation of black money. It is a constitutional demand. So far, no government is ready.
Many other points present in this work are similarly related.
After the meeting with the secretaries, the Prime Minister scrapped 4 Cabinet Committees. It is not clear whether he abolished the Cabinet Committee on Disinvestments or not.

         
          Chinese foreign minister Mr. Wang Yi visited New Delhi on 6 June 2014.
 India must annul the trade deficit with China within, say, five years.

The Prime Minister of India, on 7 June 2014, asked his Members of Parliament (MPs) to stop touching the feet of senior leaders. He wanted them to be regular and well prepared before speaking in the House. He asked them not to speak to the media as spoke persons of the party but raise the issues of their area.
It is customary for the media to consider the MPs and others as spoke persons of the party as and when they want to destabilize the government.

In continuation of his meeting with the secretaries, Prime Minister Mr. Modi, on 10 June 2014, asked the Union Ministers not to issue any illegal orders to the civil servants.
This direction will acquire a meaning only if he is ready to put right the public wrongs committed by his predecessors.
He, further, asked them not to give an opportunity to malign the government on any issue.
The Prime Minister alone could malign the government because the Union Ministers cannot do anything illegal without his consent.

Prime Minister Mr. Modi, on the same day, issued a Code of Conduct (CoC) for ministers. According to this, the ministers must submit their assets, liabilities and business interests to the Prime Minister within two months.
Further, they must sever all connection with the conduct of any business.
It is very difficult to achieve because there is no Freedom. Further, the clients of some Union Ministers are big companies.
The CoC specifically states that “the Minister must refrain from starting or joining any business, ensure that the members of his family do not start, or participate in, business concerns, engaged in supplying goods and services to that government or dependent primarily on grant of licences, permits, quotas, leases etc from that government”.
These are the demands of the Constitution of India.
However, the CoC impairs the reason.
 Mr. Arun Shourie, was the Union Minister for Disinvestments under Mr. A.B. Vajpayee.
The Cabinet Committee on Disinvestments (CCD) was under him and it remained independent of the Union Cabinet, Prime Minister of India and even Supreme Court of India.
He was not a member of the Union Cabinet. But he was more powerful than all ministers in the Union Cabinet and all the learned judges of the Supreme Court of India put together.
He did not receive even Re. 1/- as bribe but apportioned public assets worth over Re.20 lakh crore among the friends and relatives of the people possessing power.
He could do this because the then Prime Minister of India felt a desire to see public assets in the hand of some private individuals.
Now, Prime Minister Mr. Modi protects him and the ministers in his Cabinet. Thus, he is the first breaker of the CoC.
He breaks the trust of the people because of political compulsions is another topic.

The Parliament discussed the Presidential address on 10 June 2014. The leader of the Congress Party, Mr. Mallikarjun Kharge, compared his party’s 44 members to the Pandavas, the five brothers in the epic, Mahabharata.
It may be noted that the Pandavas had defeated Kauravas, 100 brothers, and ruled for 36 years.
On the next day, Prime Minister Mr. Modi in his debut speech in Parliament said, “Pandavas are dead, so are the Kauravas”.
His cleverness in reply stunned not only the House but also all Indians because there was an obscure meaning.
He, further, said that India should not be scam India but skills India.
He declared that he wanted to move forward with the opposition and not without them.
He did not talk much about the Presidential address because it was empty.

After dedicating the Russian made aircraft carrier, INS Vikramaditya, Prime Minister Mr. Modi said that the defense equipment must be made internally.
The commission agents would not have relished his statement.

In the meantime, the Union Law Ministry forwarded the letter dated 11-01-2014 to the Secretary General, Supreme Court of India for necessary action. As usual, the Supreme Court concealed it. Thus the   court says that perfect injustice is more profitable than perfect justice.

This is letter No. 261.
 Prime Minister Mr. Modi wants to impair the reason to gain advantage over the people. This would make his government an illegitimate one.
Therefore, he must grant Freedom within a reasonable period, say, one month. After that his government will have become as illegitimate as the previous government.
