THROWING DUST

The last mail was submitted to Mrs. Pratibha Devisingh Patil, Her Excellency the President of India, on 13 May 2011. The same mail was sent to the Supreme Court, Indian Army, Indian Air Force and the Election Commission of India. It was posted in the blog www: howeverythinghappenedinindia.blogspot.com and a link was given to www.thattan.com   

         A two judge bench of the Supreme Court (SC) comprising Justices B. S. Chauhan and Sathasivam on 17 May 2011 observed that the tendency to malign the reputation of the judicial officers by the disgruntled elements –lawyers included- was increasing. The bench said this - in the open court - during a contempt proceeding against some advocates. The statement must be read and interpreted in the light of this work.


        The ‘Time’ magazine on 19 May 2011 gave second rank to Mr. Raja, former Union Minister, in its ‘ignominious club of privileged leaders who stepped too far’ in the world. He came behind Mr. Kim Jong II of North Korea. Mr. Gaddafi of Libya came third.
       Mr. L.K. Advani, Mr. A.B. Vajpayee, Dr. Manmohan Singh and  Mrs. Sonia Gandhi vie one another for the first place in India. Mr. A. Raja would come below at least 500 leaders in India.  Therefore, there must be a ‘force’ behind the list prepared by ‘Time’.

        The Union Government on 19 May 2011 decided to sell its entire 95 per cent shares in Scooters India Ltd (SIL). As on 2009– 2010, it had a net loss of Re. 22.03 crore.

       The Special CBI court on 20 May 2011 sent Mrs. Kanimozhi, daughter of Dr. M. Karunanidhi, a leader of the ruling United Progressive Alliance-II (UPA-II) at the centre, to Tihar jail for judicial custody. Mr. Sarad Kumar, Kalaignar TV Managing Director, was also sent to the same jail. The reasons cited were: 1. The magnitude of the crime 2.The nature of the allegations.  3. The character of evidence and 4. To pre-empt her from influencing the witnesses.

       Mr. Venkaiah Naidu, a senior leader of the BJP on 22 May 2011 described the two year rule of the UPA- II as a saga of betrayals.

       A SC bench comprising Justices G.S. Singhvi and A.k. Ganguly on 26 May 2011 quashed the West Bengal Government Order that allotted land to Mr. Sourav Ganguly, former Cricket Captain, for setting up an integrated sports school.
     The bench said that the action of the government was arbitrary and against Article 14 (equality) of the Constitution of India. The bench observed that the state should have acted within the discipline of the constitutional law.
      Justice Ganguly acknowledged that the allot tee was a cricketer of great repute. But- as a judge- he had to be objective and eschew his likes and dislikes and render justice to a cause.
       Anyone - going through the judgment –would think that the judges of the SC eschew their likes and dislikes and do their duty.
          In this connection, it must be stated that many state governments had been giving land to different persons to promote the cause of education. The governments had been describing this policy, as decisions taken in good faith.
          The BALCO judgment said that the court should not review the policy decisions.
          Yet, the bench cancelled the allotments. This proves that the Constitution of India is supreme. Using this judgment, the SC must review the BALCO judgment, and put right all public wrongs committed since 2001. Now the court is applying the Constitution for deciding small things only.

       The Department of Telecommunication (DoT) on 27 May 2011 recommended 30 per cent reservation for “Made in India” equipment.
       The above decision is consistent with this work. However, all importers must be asked to get a No Objection Certificate (NOC) from a competent authority so that no  Indian producer would be affected.

      The militant people killed 9 police men in the Chhattisgarh state on 25 May 2011. None in India condemned it.
     
       A supporter of Miss Mamata Banerjee, Chief Minister of the West Bengal state, touched her feet on 27 May 2011.The Hindu took a photo of the above scene and published it on 28 May 2011.
          In this connection, it must be noted that the above leader helped   transmit Re. 3 lakh crore in the Provident Fund (PF) to two or three boys. As the people are not aware of this, they touch the feet of such leaders.

      An accused in the 2G spectrum case submitted in the ‘special court’ that the CBI had been selective in prosecution.
     The present writer has been telling this to the SC. Now an affidavit has been submitted in this matter in a special court. The judge has not taken any decision in this matter.
          The above court dismissed two private complaints that sought an investigation to find out the role played by Mrs. Niira Radia and Mr. Anil Ambani in the 2G spectrum scandal.
          The court said that the police case could not be altered beyond recognition at the instance of third parties. The complainants –Mr. Dharmender Pandey and Dr. Furquan – were fined Re.10.000/- each for wasting the court’s time.
       However, another petitioner –Shahid Usman Balwa- got permission to seek case diary, statements of the accused and suspects, and the progress report of the 2G spectrum case.

      A court in the Kerala state ruled that the people committing crime cannot be public servants. Mrs. Pratibha Devisingh Patil, Her Excellency the President of India,   must notice the meaning of this judgment.   
   
          Tehelka Magazine leveled some serious corruption charges against Mr. Dayanidhi Maran, a Union Cabinet Minister, belonging to the DMK party.
       

        Mr. Hosni Mubarak, ousted President of Egypt, tendered his apology for any offence caused to the people.
     Mr. A.B. Vajpayee, Mr. L.K. Advani, Mrs. Sonia Gandhi, Dr.Manmohan Singh and Mrs. Pratibha Devisingh Patil should examine whether they should follow suit or not.

     Sri Lanka on 31 May 2011 said that the LTTE was defeated only because of the support extended by India.
      It is imperative that the people responsible for extending military support to Sri Lanka must be identified.

          The Centre for Public Interest Litigation (CPIL) on 2 June 2011 submitted in the SC that Mr. Dayanidhi Maran functioned as the Telecom Minister from 23 May 2004 to 15 May 2007. During his tenure he granted 14 licences to Aircel. In return a Malaysian company- Maxis Group - bought 20 per cent shares of Sun Direct – a private company of the relatives of Mr. Maran -  for Re. 599 crore The CPIL alleged that it was bribe money. One or two newspapers alleged that he forced Mr. Sivasankaran to sell his Aircel by ignoring his demands. Mr. Maran filed a deformation case.
       The advocate of the CPIL was Mr. Prasant Bhusan. The media did not mention the names of the judges in the bench. The judges are afraid of him because he might publish the list of the judges in his payroll.
          The Indian Express on 2 June 2011 reported that Mr.Maran illegally got a 323-line telephone exchange. The public sector BSNL laid underground cable through public property to the SUN - TV office thereby causing a loss of over Re.400 crore to the nation.          

          Swamy Baba Ramdev threatened to go on a hunger strike from 4 June 2011 onwards against corruption.
       As the media started giving all India publicity to the above, many Union Ministers met him. In fact, it was reminiscent of the publicity given to the hunger strike of Mr. Anna Hazare. This shows that both would not demand the Government to use public assets for public welfare.

               The Neyveli Lignite Corporation (NLC) – a PSU- got a profit of Re.1,298 crore in the year ended March 2011. The NDA government had taken a decision to sell it for about Re.1000 crore.   
      Cairn India – a private petrol exploration company - got a profit of Re. 6712.2 crore for the year ended 31 March  2011 out of its total revenue of Re.10,277.93 crore. The profit in the previous year was Re.1623 crore.
          None gave any reason for the spurt in profit. It may be attributed to the audit by the Comptroller and Auditor General of India (CAG).
      In this connection, it may be reiterated that the profit is not the good luck of any private individuals. Consistent with Article 14, it must be taken over forthwith.
           
         Government now raised Re.1162 crore by selling five percent shares of the public sector Power Finance Corporation in this month.
        It is pertinent to recall that the National Democratic Alliance (NDA) Government sold properties as well as the shares of the Public Sector Undertakings (PSUs). For this, it gave public money to them. At times, it deposited tax payer’s money in the banks under one pretext or other.
          Thus the Government targeted to raise Re.12000 crore through disinvestments during 2001-2002. But, it plotted to give over Re.40,000 crore to the UTI alone through budgetary provisions. A few individuals used the entire money for buying the PSUs or their shares. This was the genesis of the betrayal.
          Mr. L.K. Advani and Mr. A.B. Vajpayee were behind this and it is the reason why the former does not utter a word against the act of selling public properties. For the same reason, the latter absconds, or the media protects him.
          Presenting the report card of the UPA- II, Dr. Manmohan Singh said that he was taking steps to reduce discretionary and arbitrary use of power by officials. He added that he had been taking action to root out corruption. So long he succeeds in giving public money to private parties he will go on talking like this.
          On the above occasion, Mrs. Sonia Gandhi said that the Government was taking steps to prevent any financial scandals in future. The meaning is not a clear one.

     
       2195 students from the Indian Institute of Technology (IIT) Madras zone have found their names in the Joint Entrance Examination – IIT-JEE Common Merit List (CML). 1614 students are from the Andra Pradesh state alone. 227 students are from Tamil Nadu state.
        It must be reiterated that the position in the IIT-JEE-CML is not an index of the intelligence or ability of the students. It is an index of the nature of the coaching. Therefore, all Chief Ministers must demand a definite number of seats for their states.
       Miss Jayalalitha, Chief Minister of Tamil Nadu state, cancelled the Uniform Education System (UES) introduced by her predecessor. As the UES enriched the earlier state syllabus, she could have continued it for the Government and the aided schools.

            The Central Information Commission directed the Central Bureau of Investigation (CBI) to give reason why Ambani brothers were not charge-sheeted in a 2006 case relating to the alleged masking of international calls as local calls.

          Mr. Yogesh Agarwal, Chairman of the Pension Fund Regulatory Development Authority (PFRDA) on 2 June 2011 said that only 50 per cent of assets of about Re.9000 crore in the new Pension Fund would be invested in the stock market.
          He said that LIC Pension Fund Limited, SBI Pension Fund Limited, UTI Retirement solutions, IDFC Pension Fund Management –a company formed in 2009 - Kotak Mahindra Pension Fund and Reliance Capital Pension Fund were managing the money.
          The IDFC Pension Fund was formed only in 2009. An enquiry alone would reveal the nature of the people behind the IDFC Pension Fund.
        There were reports that the Pension Fund had Re.3 lakh crore. Now the Government says that it has only Re.9000 crore.
          In this connection, it must be stated that the UPA- I Government had taken a decision to hand over the money in the Provident Fund to two or three private parties. The people believed that Mrs. Pratibha Devisingh Patil, Her Excellency the President of India, vetoed the decision based on this work. Now there are reports that the money –Re.3 lakh crore- had actually been given to them. Everything happened secretly.
         None expects anyone to do any service to the nation. But, everyone expects others to do their duty. Everyone believes that Her Excellency the President of India has been doing her duty. Alas! She has been throwing dust into the eye of 1000 million people. Unless otherwise prevented, she would continue to do this and the entire Pension Fund would go the way of the Provident Fund. 
     
      The facts from 14 May 2011 to 3 June 2011 are being submitted to Her Excellency the President of India on 4 June 2011.
