THE NEW STAND


         The last mail was submitted to His Excellency the President of India on 20 July 2013. The same mail was sent to the Supreme Court of India, Indian Army and Indian Air Force.   Later, it was sent through post to the President of India and the Chief Justice of India; and posted in the blog www. howeverythinghappenedinindia.blogspot.com

      The Reserve Bank of India (RBI), on 22 July 2013, started to scrutinise over 3000 non-banking financial companies.
   Thus, the RBI has started to obey this writer. The people must know it.
      The RBI must depute necessary number of officers to supervise every entity on a permanent basis. If it is not feasible of compliance, it must accept full responsibility for the public money.
   
  A 400 year old Rajput fort at Delhi was auctioned, on 21 July 2013, for Re.7 crore. The fort had been under the Maharaja of Alwar until it was taken over by the government in 1960.
    It is another sad day for India.
    The government must protect all old structures. Even the stone load carriers, old stone articles and the stone sheds present all over India must be protected on a war footing.

      The director of the CBI, Mr. Ranjit Sinha, conducted the marriage reception of his daughter on 21 July 2013. Prime Minister Manmohan Singh, Congress President Sonia Gandhi and many top political leaders attended the function.
    Chief Justice of India Sathasivam graced the function. All learned judges of the Supreme Court of India also might have stood in a long queue to register their presence.
      The reception defeated the one conducted by the chief of Sahara Company in terms of the dignitaries.
    How could an officer spend this much money?
     If invited, the students – out of fear- attend the marriage of their teachers. The director, CBI, should not place such constraints on the system.

   The Department of Income Tax, on 23 July 2013, raided 40 premises of Saravana Bhavan Rajagopal in the Tamil Nadu state.
   There are several bigger offenders.
    He has every right to equal treatment and the Chief Justice India has a duty to protect his constitutional rights.
    Therefore, competent officers must file an affidavit in the Supreme Court of India that the raids are being carried out from top to bottom in the “gravity of offence scale”.
   All raids now originate from the mind of the Chief Justice of India although the President of India is equally responsible.
    
   The media, on 23 July 2013, reported that Prime Minister Manmohan Singh would attend the UN General Assembly in September, 2013 and then visit Washington for a bilateral summit with the President of USA, Mr. Barrack Obama.
      On his way back, he must call on Her Highness Queen Elizabeth II partly to iron out the differences associated with the “Delhi Commonwealth Games” and partly to show that he has an honoured place in the world.
 
   Prime Minister Manmohan Singh, on 25 July 2013, constituted a “Steering Group” to accelerate public investments. This Group would award contract works for 17 projects after September 2013.
    In this connection, it must be stated that all public savings must be used for public investments.
    If he had used the Re.3 lakh crore in the Provident Fund (PF) for public investments, the manufacturing sector would have seen unprecedented development.
     Thanks to greater economic activity, the people would have bought more gold than what the recipients of the PF had bought.
  
    Chief Justice Sathasivam, on 27 July 2013, advised the graduates in law that they should not allow money or fear to influence their decisions in life. He added that the true value of legal education was the ability to contribute to social welfare.
   The Chief Justice of India could either give Liberty, or take it away.
   He now takes away the Liberty by talking like this. Otherwise, why does he “fear” to talk after giving Liberty?

    A prominent leader of the BJP, Mr. Arun Jaitely, on 28 July 2013, said that the existing method of appointment of judges must be changed to attract the best talents.
   No advocate has rejected the offer to become a judge of the Supreme Court. Are they “a bad lot” just because of one or two observations? Why did he remain silent for over twelve years?
    He must elaborate his statement.

   A Supreme Court bench comprising Justices G. S. Singhvi and K.S. Radhakrishnan asked the CBI the reason for not taking action on the so-called Niira Radia tapes. The bench, further, said that action should have been without waiting for its order.
      The CBI had considered the Supreme Court as a part of the system as mentioned in letter No.220.
   The new stand shows that the Supreme Court does not want to be a part of the system.
     Further, the new stand makes the CBI an accused body.

     Another bench of the Supreme Court comprising Justices G.S. Singhuvi and Gopala Gowda wanted to know whether the Department of Income Tax informed the criminality of the conversation in the Niira Radia tapes to the CBI.
    If the bench really means what it says, the CBI would have to take action over the criminality mentioned in the letters and inform it to the people immediately.

   A bench of the Supreme Court comprising Chief Justice Sathasivam and Justices Ranjana P. Desai and Ranja Gogoi, on 29 July 2013, sent notices to the Reliance Industries Limited (RIL) on a Public Interest Litigation (PIL) petition filed by a Member of Parliament, Mr. Gurudas Dasgupta.
  As an MP, Mr. Dasgupta had allowed the sale of some Public Sector Undertakings (PSUs) to the RIL. Does he accept the decline of Parliament now?
      
     The investigators of Income Tax, on 30 July 2013, raided 29 premises of Meenashi Amman Trust group educational institutions in the Tamil Nadu state.
     The above raid shows that there are many institutions with the attributes of the “SRM group of Institutions”.
    Therefore, all institutions should have been raided simultaneously.
   The raid over the SRM group might have alerted others to manipulate the documents.
   The government should have supervised the institutions as demanded by this writer. Action could have been taken based on the report of the supervisors. This would have prevented the uncontrolled discretion.
   Now, the competent authority must publish the method used to differentiate the SRM from the rest.

    The Securities and Exchange Board of India (SEBI), on 30 July 2013, wanted the Supreme Court to punish Sahara Chief Subrata Roy for contempt of court.
        The Supreme Court did not ask the government to run the Sahara Company. It did not order it to hand over the money - due to the fictitious account holders - into the treasury. In fact, the court does not talk about the real offence at all.
    Further, there must be many other companies with similar attributes
     Action must be taken against all offenders simultaneously.

   The Union Cabinet, on 1 August 2013, cleared the sale of 10 per cent shares of the public sector Indian Oil Corporation (IOC) for Re. 3840 crore.
    After causing economic deprivation of the order of $ 1 trillion in gold trade, the government wants a small amount by selling the PSUs.
    Whatever happened, the sale is unconstitutional because the government does not give freedom to the people to know this work.

     A report, on 1 August 2013, said that the depositors of the bankrupt SUS bank decided to start an agitation on 5 August 2013.
     Apparently, the RBI is contemplating an action based on this work. Otherwise, why do they take the matter to the street now?
    In this connection, it must be stated that the judges would not easily direct the government to take over  sick banks because they cannot function as receivers.
    It must be noted that the Receiver of the SUS bank – a judge- sold some properties. But many depositors did not get any refund.

   The ruling United Progressive Alliance (UPA), on 30 July 2013 decided to bifurcate Andra Pradesh state – Telingana and  Andra Pradesh.
   A state wise reservation of seats in the All India Examination would do immense benefit to the new Andra Pradesh state.

      BJP leader Shatrughan Sinha, on 2 August 2013, considered Mr. L.K. Advani as the best prime ministerial candidate of his party.
    Gujarat Chief Minister Mr. Narendra Modi has not appeared in any public meeting after the last letter.
     Now, Mr. L.K. Advani believes that there is nothing wrong in functioning as a political leader after taking away the Liberty of the people.

      The facts from 20 July 2013 to 2 August 2013 are being submitted to His Excellency the President of India on 3 August 2013.
       The same letter is being sent to the Chief Justice of India and the Chiefs of the Indian Army and Indian Air Force for necessary action.

225. The Gold Prices - A Global Crisis

A SYMBOL OF SHAME

    There were some active consultations after the above letter. The Finance Minister met the Prime Minister and discussed the economic situation. Further, cancelling an appearance at a Mumbai College, Governor of the RBI Subbarao reached Delhi on 15 July 2013.
 
        United Nations (UN) Secretary General   Ban Ki-moon commemorated July 12 as Malala Day.
    Addressing the UN, Pakistani school girl Malala Yousafzai declared, “One child, one teacher, one pen and one book can change the world. Education is the only solution”.
    Is this work not an example for this?

   The principal opposition party, the BJP, on 13 July 2013, said that the UPA Government failed in managing the Indian economy.
   This is the reaction of the BJP for the last letter.

      Gujarat Chief Minister Mr. Narendra Modi, on the same day, said that the Congress party was “cheating the people”.
     He should not do the same.

     The Union Government hiked the price of petrol by about Re.2 on 14 July 2013.
     The present writer had been requesting the government to use the Re.3 lakh crore in the Provident Fund (PF) for large scale public investments. Divesting the people of their right to know this, the government handed over the money to the private parties. The recipients used the money to buy and sell gold. As a result, the price of gold increased from $600 to $1800 per ounce.  
     When the government discouraged the import of gold, the price fell to $ 1200. The role played by other nations in this matter is not known till date.
   However, in order to annul this in the domestic market, the government devalued the currency.
   Thanks to the devaluation, everyone – the deaf and dumb included - must pay higher price for petrol.
    Is it not worse than cruelty to animals?
    The devaluation is necessary for the growth of some other  sectors is a different matter.  

     Chinese helicopters entered the Chumar sector of Ladakh on 1 July 2013. The newspapers reported this on 14 July 2013. Its soldiers had taken away an Indian surveillance camera a few days earlier.

    Koodankulam Nuclear Power Project (KKNPP) attained criticality on 14 July 2013. As the government ignored the 15 conditions demanded by the Supreme Court of India to open the plant, the People’s Movement against Nuclear Energy (PMANE) staged a black flag protest on the next day.

     The New Indian Express, on 15 July 2013, said that the judiciary was opposing the suggestion to change the “Collegium System” of selecting judges.
      So long as a judge does his duty, the people would not like to know whether he is a person of low birth or high birth.
   However, the learned judges of the Supreme Court of India –as a rule- do not do their duty because they refuse to give their answer to the letters of the President of India.
   Is the “collegiums system” not responsible for this?

    Gujarat Chief Minister Mr. Narendra Modi said that the Congress Party wanted to keep the people poor. He added that there was no shame in the Congress Party. This was the front-page headline news of many newspapers all over India on 15 July 2013.
    Obviously, the recipients of the PF money confine most of the leaders to state level politics; and promote some exceptional persons for all India politics. They have selected Mr. Modi for the latter role.
    Now, if he wants to take away the Liberty of the people to know this work, he is a symbol of shame.

    The Union Minister for Commerce and Industry, Mr. E.M. Sudarshan Nachiyappan, on 14 July 2013, said that the recent order of the Supreme Court –barring a person in custody from contending elections, was a recipe for disaster.

   The Reserve Bank of India (RBI), on 15 July 2013, penalized 22 banks for money laundering.
    The duty of the RBI is not simply collecting license fee or imposing fine.
     It must keep a strict supervision over all banks by sending necessary number of officers.
   It must take over all collapsed banks like the SUS bank in the Tamil Nadu State and refund the money of the depositors.
  Further, it must prevent the banks from possible collapse due to factors such as fall in gold prices and others.

    The Union Finance Minister, Mr. P. Chithambaram, on 16 July 2013, requested the people to reduce consumption of precious metals.
    He had encouraged the people to buy gold coins at $ 1800 per ounce. Now, he discourages them to buy at $1200!

   Mr. Narendra Modi, on 15 July 2013, described himself as a nationalist because he was a born Hindu.
    A Christian -doing his duty- becomes a born Hindu.

   Mr. P. Chithambaram, Union Finance Minister, on 16 July 2013, said that the policies of the Government such as the “Food Security Bill” touched the poor people.
     At the current rate, India lost about 1500 tonne of gold in the last three years.
        If the value of gold in the hand of the people in physical and virtual     forms is taken into account, India lost an unimaginable amount - about US$ one trillion.
    The investors all over the world might have lost about US$ three trillion in the last one year.
   It is a global crisis triggered by India and possibly China.
   Now the Finance Minister says that his “Midas touch” has a touch of humanity!

    Union Minister Anand Sharma, on 16 July 2013, said that India got FDI worth $290 billion in the last nine years.
    He indirectly says that this would compensate the loss suffered in gold.

    In an affidavit submitted in the Supreme Court of India on 16 July 2013, the CBI said,
  “ 1. The director, CBI, must be selected by a committee comprising the Prime Minister of India, the Leader of the opposition in the Lower House and the Chief Justice of India”.
     If an evil man is selected, he will not turn into a gentleman. This is the concept behind selection over seniority.
   Therefore, the director must be appointed strictly based on service seniority.
  2. “The director, CBI, must have minimum 3-year tenure”.
     This is to perpetrate illegality.
   An honest person might do wonders even within a span of one month.
3. “The CBI must have the power to report directly to the Union Minister”.
   This shows its willingness to obey illegal orders.
4. ‘The CBI has a zero tolerance policy against misconduct by its personnel”.
   It is well known that some Indian Police Service (IPS) officers act in bad faith.
     One day, the present writer telephoned a doctor. On the next day, his tiny clinic was searched.
  Again, one day the present writer telephoned one of his relatives working in an institution. On the next day, his institution was raided by an agency.
   These may be mere coincidences.
   The fact that the CBI and the Chief Vigilance Commissioner (CVC) together concealed 224 letters cannot be denied.
   The CBI even refused to accept some letters.
   Therefore, the statement of the CBI cannot be trusted.

   The New Indian Express, on 17 July 2013, said that poverty levels across India decreased by 15 per cent –approximately 2 percent year over year since 2004- 2005.
   The paper says this to suppress the consequences of the colossal loss suffered by India in gold trade.

   POSCO, on 17 July 2013, scrapped its proposed US$5.5 billion steel plant from the Karnataka State.  On the next day, Arcelor Mittal pulled out his US$ 12 billion steel plant in the Odisha State.
     The government could confiscate the gold and other assets present in the hand of the recipients of the PF money for investments in the mining sector.

    The Cabinet Committee on Security (CCS), on 17 July 2013, cleared a proposal for a mountain strike corps along the China border.

  The Supreme Court, on 17 July 2013, asked the CBI not to share any information with the government on its coal allocation case.
    If the Supreme Court believes that the CBI is a better entity than the government, the latter has no right to exist.

    The Supreme Court, on 17 July 2013, asked Sahara Company to refund Re.24, 000 crore to the 3 crore investors.
    The Supreme Court knows that 90 percent of the accounts are fictitious. Yet, it repeats its order. It means that it is losing command.

    On a petition seeking a CBI probe into the Saradha Chit Fund, a Bench of the Supreme Court, on 18 July 2013, sent notices to the union government and the West Bengal government.

    The New Indian Express, in its editorial on 19 July 2013, said that India must be prepared to take on China.
    China has already swallowed India.

    A Supreme Court Bench comprising Chief Justice Altamas Kabir, Justice Vikramageet Singh and Justice Anil Dave, on 18 July 2013, quashed the National Eligibility cum Entrance Test for admission into medical and dental colleges.
    Due to this judgement, the students from one state cannot usurp the seats in other states as in the IIT-JEE. However, the system would try to circumvent this judgement.

   Prime Minister Manmohan Singh, on 19 July 2013, declared that the import of gold would be restricted.
     He has thrown 1500 tonne of gold into the Atlantic Ocean and asked the New York bullion market to decide the destiny of Indians. As the people do not know this, he wants to save the country.

    Justice Sathasivam, on 19 July became the 40th Chief Justice of India. Senior Advocate Sethuraman said that he was a fair and just judge.
   224 letters roll in his hand. It is not necessary to point out his duties one by one. He might do justice.

A COLOSSAL LOSS

    The Union Cabinet met on the next day. It decided to set up 51 low cost airports. The government, on the same day, said that Re.1.15 lakh crore would be invested in infrastructure projects in this year.
    The Government should have done this on day one of assuming power.

    The Department of Income Tax, on 2 July 2013, seized four big trucks - parked at Mumbai Railway Station - full of brief cases containing high denomination currency notes, gold and diamond. 47 people were detained and twenty were let off after initial questioning. They had planned to load it in a train going to Gujarat. A few police personnel under an Inspector of Police had escorted the trucks.
    The learned judges of the Supreme Court might have noticed the above detention. Yet they did not consider it as their duty to reveal the story behind this money. Is there any other authority to enlarge the freedom of Indians?

     BJP leader Mr.  L. K. Advani, on 2 July 2013, praised Sardar Vallabhai Patel for forcefully integrating Hyderabad into the Indian Union despite the opposition of Mr. Nehru.
    Thus he supports Chief Minister Narendra Modi to install a statue of Mr. Vallabhai Patil by spending over Re.2500 crore.
   The statues of all post independence political leaders that exist all over India are a symbol of slavery because they grew and functioned as the slaves of the manipulators.
   The above condition slightly disturbed the mind of former Union Minister Mr. Shivaraj Patil.
  The people will remember Queen Elizabeth also because she did not hesitate to use her moral power to give Liberty to Indians.

   The Central Bureau of Investigation (CBI), on 8 July 2013, demanded the Supreme Court of India, to modify its earlier order to make it an autonomous body.
      The demand of the    CBI shows that the government does not want ignorance to rule the destinies of this beautiful country.
   Earlier the government had approached the Supreme Court, in vain, to give answers to the unanswered questions. 

      The next Chief Justice of India, Justice P. Sathasivam, on 8 July 2013, said that the Other Backward Communities (OBCs), Scheduled Castes (SCs), Scheduled Tribes (STs) and the minorities must get adequate representation in the Supreme Court although there was no reservation rule.
    The learned judges –while talking like this- keep the SCs, STs and the OBCs away from the Supreme Court.
    As a senior judge of the Supreme Court for many years, Justice Sathasivam could have rectified this. He did not do so.
   Will not the people doubt his integrity now?
      Justice Sathasivam alone could answer the above question.

      Edward Snowden, former Central Intelligence Agency (CIA) employee, said  that the USA spied on foreign missions – India included.
    Mr. Salman Khurshid, External Affairs Minister of India, said that the surveillance of the USA did not amount to “snooping”.
    To this the BJP leader, Mr. Ravi Shanker Prasad, wanted the government to share all available facts with the political parties. Mrs. Brinda Karat, a leader of the CPM, said that the surveillance violated the UN conventions.
    The government then agreed to take up this matter with the USA.
    It must be noted that the media reported the views of the representatives of the manipulators alone in this matter.
   
    India witnessed a great natural calamity at Kedarnath in the last week of June 2013. Flash floods- the worst to hit Uttarkhand  State in a century- devastated Kedarnath and the surrounding areas. Thousands of pilgrims died.
    Japan condoled the Uttarakhand deaths and announced an emergency grant of $ 2,00,000 (abut Re. 1.2 crore) through International Federation of Red Cross. The USA announced an aid of $ 75,000 through an NGO called Catholic Relief Services.
    When the Tsunami destroyed the east coast, Prime Minister Manmohan Singh refused to accept a huge amount of aid from many countries. Now, he is ready to accept even a small amount!

  The Union Government, on 3 July 2013, sold 4.01 per cent shares of the public sector Hindustan Copper Limited (HCL) for Re.260 crore.
   The sale is an illegal one because the government sold them after taking away the Liberty of the people to know this work.

    The Governor, Reserve Bank of India (RBI), on 8 July 2013, said that eleven officers would supervise the functioning of the private rural banks in the Tamil Nadu state.
     This is not sufficient. Two or three officers must supervise every big private bank on a permanent basis.
    When the SUS bank in the Tamil Nadu state became sick, hundreds of people died of heart attack.
    The liquidation of the above bank benefits the liquidator – a judge- only.
   Therefore, the RBI must direct the state government to take over this bank and refund the money to the depositors forthwith.
  
  According to a report, the trade deficit of India with China stood at $ 29 billion in the last year.
     It is one of the greatest disservices the government is doing.

   The Supreme Court of India, on 10 July 2013, asked the government to tell the reason why the CBI should seek the sanction of the government to prosecute public servants in court monitored cases.

   The Supreme Court, on the same day, asked the government to justify the method of coal allocation.
   It is pertinent to recall that, on 7 May 2010, a three judge Bench of the Supreme Court observed in its judgement that all natural assets must be handled by Public Sector Undertakings (PSUs). It even used the words “constitutional democracy” as mentioned in Letter No. 139. Had the judgement been executed, the question of allocation would not have come at all.
    Is it not the duty of the Supreme Court of India to justify its action now?

    Striking down a provision in the electoral law, a Bench of the Supreme Court comprising Justices A.K. Patnaik and S.J. Mukhopadhaya, on 10 July 2013, held that the Members of Parliament (MPs) and MLAs, on conviction for offences would be disqualified from holding membership of the House without being given three months time for appeal.
    While striking down the provision, the Bench should have provided against failure of justice in the courts.


  Union Finance Minister Mr. P. Chithambaram, on 10 July 2013, requested the US companies to invest in India. Earlier he had advised Indians not to buy gold for one year for the sake of the Indian economy.
    India resorted to the devaluation of the currency to prevent the prices of gold from falling in the domestic market. Yet, the prices of gold are falling.
       The reason for this paradox must be noticed.
    The Union Government gave Re. 3 lakh crore in the Provident Fund (PF) to private parties when the international price of gold was around $600 per ounce. The recipients were encouraged to buy gold. As a result, the prices of gold increased to $1800. When India discouraged the import of gold, the prices fell to $1200.
     According to a rough calculation India lost about $ 200 billion in this year. If the Supreme Court could disclose the whereabouts of the PF money a precise calculation could be made.
   No political party is ready to murmur anything about this.
   Who is responsible for this colossal loss?  
   If the Supreme Court had given Liberty to the people to know this work, this would not have happened.
    Is it not the Supreme Court that had committed robbery on the innocent Indians?
