CHAPTER 145. DEVELOPED MINDS

145

REBIRTH

Some newspapers now said that the Indian telecom companies would buy Chinese equipment after obtaining security clearance from an international certification agency. This shows that India has no free existence in this sector. Therefore, unless otherwise prevented, the success achieved by Her Excellency the President of India during her visit to China would go down as a short lived one.
The Chief Election Commissioner (CEC) on 5 June 2010 said that some private manufacturers were behind the propaganda that the Electronic Voting Machines (EVMs) were vulnerable to manipulations.
It must be noted that the EVMs failed on two very crucial occasions in the Parliament. The entire world watched it. Some say that the votes recorded by the EVMs did not tally in several constituencies and this fact was covered up by telling one reason or other. Therefore, all right thinking people all over India want the ballot paper for voting. The Election Commission of India must tell the real reason for its long fascination with the EVMs. The CEC does not ensure FREEDOM is a different matter.
A retired Wing Commander said that the army could be asked to use lethal weapons against the domestic enemies. According to him, army could be authorized to raid premises and seize documents. THE HINDU published his views on 6 June 2010 in its OPEN PAGE.
The above paper believes that the armed forces exist not to confiscate $1 trillion given to less than ten people but to help the transmission of $1 trillion to them in the next four years. With this objective, the paper might have met several retired officers of the armed forces to obtain an article.
The above article proceeds with the assumption that the enemies of the nation are militant people in the jungles and not the people possessing the power to transmit the natural resources. This shows that the manipulation mafia wants to trap the leaders possessing the mandate to rule India.
This article is the consequence of the denial of FREEDOM in India.
One could put the blame on the entire system –from the President of India to the Supreme Court (SC), the leader of Congress party to the leaders of the political parties, the Prime Minister of India to the Union Ministers and the manipulators to the media mafia –for the denial of FREEDOM. However, all right thinking people would say that the leader possessing the mandate must be specifically responsible for this.
Therefore, the above leader could show any one of the three following ways to the Union Government:
1. A way to give FREEDOM.
2. A way to deny FREEDOM.
3. A way to ignore the matter.
The USA on 6 June 2010 said that India was destined to be a nation of global influence.
The Chief Judicial Magistrate, Bhopal awarded a maximum of two years to the eight accused in the Bhopal gas tragedy case. The judgment came after 26 years. This was the headline news for all newspapers on 7 June 2010.
In this connection, it must be pointed out that the Union Carbide Company, USA, came forward to give some compensation to the victims immediately after the tragedy. Besides, it clearly predicted that the court cases would not give real remedy to the victims. But some lawyers and the media in India foolishly advised the then Union Government to go to the court. As a result, thousands of victims died without getting any compensation.
The New Indian Express on 7 May 2010 in a centre page article said that India lost about $ 42 billion in the 2G spectrum allocation. This shows that the Government lost $ 1 trillion in the last six years and the entire money must be recovered. But the Government has no courage to recover the money.
The predecessor of the present Chief Justice of India took charge as the sixth Chairperson of the National Human Rights Commission (NHRC) on 7 June 2010.
It must be noted that a three judge SC Bench headed by the Chief Justice of India heard the gas dispute case. In its judgment on 7 May 2010 the judges clearly said that the natural resources must remain under the Government. But they have not come under the Government. Instead, the remaining natural resources like the 3G spectrum went in the hands of some people within days of the judgment.
The Supreme Court should have taken a firm stand in the above matter. If it considered the natural resources as public money, they should have come under the Government. If it considered them as private money, the SC need not have expressed a contrary opinion without any teeth.
Evidently, the Chief Justice of India- like a brave warrior- could have finished his duty satisfactorily and gone to the stars. Then the judgment would have uplifted 1000 million people instantaneously. But he would not have got the present post.
Will anyone in the SC come for the emancipation of 1000 million people in the near future? It is doubtful.
The media reported the above case only sparingly. Yet some people might have followed it. They might have noticed that after hearing the case, there was an inordinate delay in pronouncing the judgment. This writer had duly pointed out this. The judgment came out only on the penultimate day of the date of retirement of the Chief Justice. During this time, the Chief Justice murmured that he saw nothing wrong in judges accepting certain positions after their retirement.
The Chief Justice would not have bargained for a post retirement position. However, the Government might have brought to his notice the vacancy in the NHRC at one time or other. The desire for this position might have diluted the severity of the judgment. Naturally, the Chief Justice did not rise to a higher form.
It is said that a man takes one kind of body and again quits it to take another. The Chief Justice is taking the body situated in the mode of passion to the NHRC. His rebirth is in this world only. If he could rise to the mode of goodness, he would - even in the present post- give meaning to his judgment.
Otherwise, he would do more harm than good to the nation. This is because the people perceive him as a brave warrior. Because of his presence, they think that nothing wrong is going on in India. But he knew that he converted 1000 million people into untouchables.
However, it is said that only developed minds could see what is taking place in front of them.
The important point is that the judges are flexible to political threats. The political leaders would achieve their economic and political objectives by appointing suitable judges or by offering suitable positions. If one or two judges – in rare cases - were incorruptible, they would not get good cases. Or the Government would wait for their retirement. Therefore, the Supreme Court must take necessary steps to save the judiciary from political threats- a threat that emanates from the manipulators. Then only it would hear the cry of the people to protect their fundamental rights.
The facts from 4 June 2010 to 8 June 2010 are being submitted to Her Excellency the President of India on 9 June 2010.
