‘PERFECT
INJUSTICE MORE GAINFUL THAN PERFECT JUSTICE?’
The Union Government, on 26 March
2015, submitted before the Supreme Court of India that the spectrum auction had
yielded Re. 1.09 lakh crore.
The court must reveal whether the sum of
Re.1.09 lakh crore is for one year or for 30 or 50 years.
The court should not fail in this
matter.
The people should not think that
there is no qualitative difference between the prime minister and the court.
The Supreme Court of India, on the
same day, granted permission to the government to finalize the auction of the
spectrum.
The executive makes the laws official.
The court must rule whether
something finalized by the executive is constitutional or unconstitutional.
It is not the competent authority
to grant permission to the executive to finalize anything.
When the court does this, the people
cannot send a letter to it to prevent the government from abusing its power.
Evidently, the three separate Branches
of Government – the executive, the legislature and the judicial- shall not coalesce
into an unconstitutional entity.
It is pertinent to recall that the
Supreme Court - with a view to its several interests- had granted permission to
the government to take away the salary and the pension benefits of the public
servants.
Now, the story repeats because the
people are not at Liberty to look at this work.
All that the prime minister wants is a
seal by the Supreme Court of India.
The court has given it.
It is perfect injustice.
The prime minister wants the seal
because ‘perfect injustice is more
gainful than perfect justice’.
