There are reports that the public sector State Bank of India
(SBI) is to buy 24 per cent shares of Jet Airways.
This is out and out unconstitutional. The banks exist for
lending money and not to buy the shares of the companies of the promoters of
the political leaders or the judges of the Supreme Court of India.
The motive is to give a huge amount of public money to the
Jet Airways to save it from bankruptcy and sell the shares back after some
time. The public sector banks refused to do the same when the Kingfisher
Airlines of Mr. Mallya and the Satyam Computers of Mr. Rama Linga Raju
frantically ran for money. In fact, an arrest warrant is pending against the
former and the latter was mercilessly sent to jail.
The SBI lends money to the people all over India only for
interest. The act of buying the shares of preferred companies and the act of denying
the same benefit to others is a violation of the Article 14 and many other
sections of the Constitution of India. The tragedy is that the Government
alienates the public assets for money after giving the public money to some
people like this.
The act of advancing public money to buy the shares of some
companies is illegal because others do not get the same benefit. When the
present man sent letters to the newspapers, they refused to publish them.
Therefore, it was one of the points in the first letter dated 1-6-2001.
The then President of India, Dr. Abdul Kalam, and his
successor, Mrs. Pratibha Devi Singh Patil, virtually stopped this
unconstitutional policy decision. But, whenever the present man remains silent,
the Supreme Court of India plunders the public money like this. Can any man
live for ever to police such actions?
If a war had broken out between India and Pakistan, such
things might not have come to the surface although hundreds of manipulations
happen every day. As the people focus their attentions on the elections, such
manipulations take place with greater intensity.
The tragedy of all tragedies is that the Prime Minister of
India says that he is functioning like a police man to prevent such acts. But
the people - in all their innocence - trust the patriotism of such politicians.
Evidently, all works done by the present man go in vain
because the people have no freedom to know men and matters.
Therefore, the Supreme Court of India exists only to plunder
the public resources by denying freedom to Indians. It comes under the principle of unjust enrichments. All
parties that amass wealth like this at the expense of others should be required
to make restitution.
Chief
Justice of India Ranjan Gogoi, in an absurd judgement, on 27 September 2012,
said that he lacked the expertise to understand the economic policy. In the
same judgement he said that he would strike down arbitrariness in policy
decisions. This kind of conflict could be discerned in all his crucial
judgements.
The
people tend to look at the past judgements of a judge to know his fairness. If
a judge is not fair, no good adjudication can be expected.
Now,
there is a real possibility that the present Chief Justice of India would do
injustice only. This means that he would not adjudicate these letters in an
impartial way.
The
other judges may not be open to such severe criticism. One cannot say that the
appearance of bias against freedom permeates among all judges. There must be
some exceptional judges. However, there is no way to test their impartiality
except through this work. Their personal and business background are not known.
Their affiliations are also not known. The only thinking is that they would not
deliberately try to please some politicians and business men at the expense of
1300 million absent class citizens.
This
is a critical moment in the history of India. Therefore, the judges must view
this work with an open eye and adjudicate the letters before them objectively.
The
President of India also must act as swiftly as possible to prevent the total
annihilation of the Constitution of India. He could prevent a war between India
and Pakistan through his swift action. Now, he can ensure economic and
political justice, if he is ready to act with the same alacrity.
